NYC Cyclist Ticketed for NOT Using Bike Lane Highlights the Perils of ALWAYS Using Bike Lanes

Let’s face it, some cyclists really do deserve tickets for not riding in the bike lanes [1], especially since the lanes are there to protect everyone on the road. But sometimes the bike lanes [1] aren’t the safest or best place for cyclists to be riding. After getting a ticket from the NYPD for not riding in the bike lane, Casey Neistat [2] created the hilarious — and informative — video [3] above to demonstrate some of the dangers of ALWAYS riding inside the lanes.

The video was created after Neistat was singled out by a police officer who gave him a $50 ticket for not using the bike lane. In the video, Neistat tries to explain to the officer that at times, the bike lanes [4] aren’t always the safest place to ride in due to bad traffic conditions and other obstacles. The officer, however, was not convinced, and said it didn’t matter – you must ALWAYS ride in the bike lane [4].

The video also shows Neistat getting the ticket and complaining about the fact that he is being unfairly singled out, despite the fact that other cars in the road are also breaking traffic rules. The video has recently gone viral with more than 275,000 views (and counting), and Neistat was even featured on the radio. The video [4] is also a hilarious take on what would happen if cyclists were to NEVER leave the lanes.

As reported by Gothamist [5], NY law [6] does in fact allow cyclists to avoid bike lanes when necessary to avoid dangerous road conditions:

When reasonably necessary to avoid conditions (including but not limited to, fixed or moving objects, motor vehicles, bicycles, pedestrians, pushcarts, animals, surface hazards) that make it unsafe to continue within such bicycle path or lane.

Unfortunately, the officer doesn’t seem to know the traffic laws completely. Neistat hasn’t been too happy about the fine, and rightly so! There’s a lot of anti-bike propaganda in New York City, and the fact that police officers are unclear about the rules of the road for cyclists does not help. Here’s hoping that Neistat gets his $50 back and that the NYPD wises up about what cyclists can and can not do.
